1. Agreement to Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Pressure App, Inc. ("Pressure," "Company," "we," "us," or "our"), governing your access to and use of the Pressure website, platform, dashboard, analytics tools, APIs, and related services (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately discontinue use of the Service.
2. Eligibility
You must be at least 18 years old and capable of forming a legally binding contract to use the Service. By using the Service, you represent and warrant that: - You are at least 18 years of age. - You have the legal authority to enter into this agreement. - Your use of the Service does not violate any applicable laws.
3. Description of Service
Pressure provides analytics, metrics, performance scoring, baseline comparisons, transcripts, structured feature generation, and other derived insights related to Instagram accounts that you authorize the Service to access. The Service may: - Retrieve authorized data from third‑party services, including Instagram. - Process analytics, metadata, media URLs, and certain media-related assets needed to operate product features. - Generate performance metrics, scores, transcripts, feature labels, insights, and recommendations. - Store and display historical analytics data and derived outputs. Pressure does not guarantee accuracy, completeness, availability, or predictive reliability of any analytics or insights.
4. Third‑Party Services and Instagram Integration
The Service integrates with third‑party platforms, including Instagram. Your use of those platforms is governed by their respective terms and policies. Pressure: - Is not affiliated with Instagram or Meta Platforms, Inc. - Does not control Instagram systems or availability. - Is not responsible for Instagram outages, data changes, or API limitations. You grant Pressure permission to access your Instagram data solely to provide the Service.
5. Account Registration and Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to: - Provide accurate and complete information. - Maintain the security of your credentials. - Notify Pressure immediately of unauthorized access. Pressure is not liable for losses resulting from unauthorized account access.
6. Data Access and Authorization
By connecting your Instagram account, you authorize Pressure to: - Access permitted Instagram data. - Store analytics, metadata, and related account information needed to operate the Service. - Process media-related assets made available through the integration when required for features such as duration resolution, transcription, or feature derivation. - Compute and retain derived metrics, transcripts, and insights as required to operate the Service. You retain ownership of your original content. Pressure owns the product’s derived analytics, aggregated insights, and system-generated outputs to the extent permitted by law.
7. Acceptable Use
You agree not to: - Use the Service for unlawful purposes. - Attempt to reverse engineer or disrupt the Service. - Interfere with system security. - Access accounts you do not own or control. Pressure may suspend or terminate accounts that violate these Terms.
8. No Warranty
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PRESSURE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. Pressure does not guarantee: - Accuracy of analytics - Continuous availability - Error‑free operation - Predictive accuracy
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRESSURE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO USE THE SERVICE IN THE PRIOR 12 MONTHS, OR $100, WHICHEVER IS GREATER.
10. Termination
Pressure may suspend or terminate your account at any time for violations of these Terms. You may terminate your use at any time. Upon termination: - Your access will be revoked. - Data may be deleted. - Certain provisions will survive termination.
11. Privacy
Use of the Service is also governed by our Privacy Policy. Pressure implements safeguards to protect user data but cannot guarantee absolute security.
12. Modifications
Pressure may update these Terms at any time. Continued use constitutes acceptance of updated Terms.
13. Governing Law
These Terms shall be governed by the laws of the State of Washington, United States, without regard to conflict of law principles.
14. Dispute Resolution
Any disputes shall be resolved through binding arbitration in Washington, unless prohibited by law.
